General Terms and Conditions for Participation in ‘The Bounty Bay Online Grand Celebratory Regatta’
1. General Information/Duration of Competition
(1) Participation in the competition ‘The Bounty Bay Online Grand Celebratory Regatta’ from Frogster Online Gaming GmbH (‘Frogster’) is free of charge and non-binding. Users can end their participation in the competition at any time by sending an email to Frogster Online Gaming GmbH (support@bountybayonline.com).
(2) The competition will be held between 24th March 2010 and 31st March 2010 within the ‘Bounty Bay Online’ game.
(3) Daily during this period, an NPC (non-player character) will be available in the game who will commence the Regatta competition (hereafter ‘Regatta’). Participating players will receive information step-by-step from this NPC on how to take part in the Regatta and complete it. All players to successfully complete the Regatta will automatically be taking part in the competition. The same applies to any player to be logged into the game, ‘Bounty Bay Online’, during the time period stated above.
(4) The competition will be available on all Bounty Bay Online servers. The choice of the time at which the NPC will be available within the game remains at Frogster’s discretion.
2. Prerequisites for Entry
(1) The competition is open only to Bounty Bay Online players over the age of 18 and resident in the European Union. Participants under the age of 18 must have permission from a parent or legal guardian. Employees of Frogster Online Gaming GmbH and Frogster Interactive Pictures AG and their families are not eligible to participate.
(2) Through participation all participants agree to the existing participation requirements. Legal recourse is excluded.
(3) Frogster reserves the right to disqualify participants from the competition who attempt to manipulate the participation process, the technical system and/or the choosing of winners, or the website; as well as those who do not respect the pre-agreed terms and conditions of participation, behave contrary to public decency, or try to influence the results of the competition by employing dishonest behaviour and methods.
3. Determining and Notification of the Winner
(1) The winner will be determined as follows:
One player will be drawn at random from all participants in the Regatta on a given day and will win 333 Euros.
At the end of the competition (Thursday, 1st April 2010) one person will be drawn at random from all of the players to have logged into the game between 24/03/2010 and 31/03/2010 and will be awarded 1000 Euros.
(2) The winner will be notified by email as well as supplied with information on how to claim the prize. Should a winner not respond within the given time period stated in this email, their right to the prize will expire and an alternative winner will be selected.
(3) Participants who are awarded material prizes (e.g. in-game items) do not have to right to claim their equivalent value in cash. Prizes are non-transferrable.
4. Data Protection
(1) The personal data listed below may be collected, saved, and processed for reasons relating to the execution of the competition.
(2) The IP addresses and Chatnames of all players to have taken part in the Regatta, as well as those to have logged into the game during the above stated time period, will be saved.
All participants in the competition automatically give their consent to the possibility that their name may be published within the ‘Bounty Bay Online’ game as well on websites run by Frogster in the event of their winning a prize in the competition.
(3) The use of participant data as stated above is necessary for the execution of the competition. By participating in the competition participants automatically give their consent to such uses of their data. This consent may be revoked at any time.
5. Declaration of Consent
Through participation in events from Frogster Online Gaming GmbH the entrants declare their consent to the production of sound and image recordings for promotional purposes without payment.
Simultaneously, the entrant grants Frogster Online Gaming GmbH and Frogster Interactive Pictures AG all copyright-related usage rights, ancillary copyrights, personal and other rights (e.g. merchandizing, ancillary printing rights, online/Internet and database rights) relating to sound and/or image recordings produced during participation in competitions without recourse to payment. This includes rights to one's own image as well as legal protection of one's name and all related usage rights. The entrant has no legal recourse to claim payment whatsoever, by way of injunction or by any other means.
6. Liability
Frogster Online Gaming GmbH and Frogster Interactive Pictures AG do not accept any liability for any technical requirements necessary for timely participation in the competition.
